A shaky legal case tears a Chinese Family apart

In Memphis, Tennessee, a wealthy family named Jerry and Louise Baker stole a child from a poor Chinese family four years ago. Ironically, the trial judge Alissandratos in Chancery Court shifts the burden of proof onto the He family (defendants). Before Judge Alissandratos, Mr and Mrs. He has to carry the burden of proving by clear and convincing evidence that they are fit parents in order to defend their parental rights. 

Back in June 2001, the Bakers filed a motion with judge Alissandratos entitled “Termination of Hes’ Parental Rights”, in which they accused Mr and Mrs. He of willful abandonment of their child, an accusation without corroboration. Very quickly, Judge Alissandratos issued a “no contact” court order barring Mr. and Mrs. He from seeing their child. This harsh order was issued in the absence of any evidence of child abuse. Since June 2001, the Bakers’ case of terminating Hes’ parental rights has been pending for a trial despite numerous efforts made by the Hes for a speedier trial. While a final trial has been pending, the court bars the Hes from contacting their child, who has been in the foster care of the plaintiffs. 

We urge you to act quickly against such abuse of human rights.

Why deny parents who want their responsibility?

The case of the Chinese couple trying to get their child back ("A shaky legal case keeps family apart," Oct. 1 editorial) teaches a lesson: A parent should not voluntarily relinquish her child temporarily to an agency or another person, through the courts or otherwise, except as a last resort. It may be very difficult to get the child back. The temporary custodian's initial intent to return the child may fade, or may be halfhearted at best.

A parent who temporarily places a child with someone may be young and without financial, family and other resources. Temporary custodians who are not so disadvantaged are often in a better position to make the legal system work for them. Crowded court dockets and case continuances can result in a nightmare for a parent. More horrifying, a child might never be returned, because our legal system is not perfect.

Placing a child because of temporary problems may be a responsible act. We know the case of the Chinese parents. But how many cases are there of parents who intended to place a child temporarily but lost that child because they unwittingly placed themselves in a difficult legal position?

I am writing this letter in response to an Associated Press article on Nov 16.

This article addresses the decision by Judge D.J. Alissandratos to step down from an international child-custody case over which he was presiding.

After reading the article, it is evident to me that Alissandratos was unfair in his handling of the case. Therefore, I agree with his decision to step down.

Social Service agents have the authority to enter and remove a child from his or her home if neglect or abuse of the child is suspected.

While this agency works avidly for the rights and safety of children, the judicial system often fails children Social Services is trying to protect. Routinely children are placed in foster care for a while and then returned to their parents who are often abusive and dangerous.

It is a vicious cycle that can cause lifelong and damaging effects on everyone involved. While Mr. He was accused of sexual assault in 1998, he was acquitted. Therefore, Anna Mae should be returned immediately to her parents.

The Hes have suffered and endured enough from our judicial system.

Five years ago today, two Chinese immigrants, plagued with legal and financial problems, gave their infant daughter to a Memphis couple they say promised to care for the child until the parents could get back on their feet.
Shaoqiang and Qin Luo He, who go by American names Jack and Casey, did get back on their feet, but they didn't get their daughter. What followed was a bitter fight for custody between the Hes and the couple who want to adopt her, Jerry and Louise Baker.

Today the war over this little girl might finally be coming to an end in a Memphis courtroom as both birth and foster parents try to convince a judge that they should raise her.

Testimony differs on trauma girl faces

Psychologists disagreed Tuesday about the trauma that a 5-year-old Chinese girl suffered from losing her birth parents, and the loss she would experience if taken from her American foster parents. 

.....Parrish said a "no contact" order forbidding contact between the Hes and their daughter was ordered by Alissandratos at the end of a Feb. 7, 2002, hearing as other parties were leaving the courtroom. Parrish said Alissandratos told him to draft the order, and what to write. 

David Siegel, who represents the Hes, has questioned whether the order came from a private conversation between Parrish and Alissandratos.

Judge Won't Reunite Couple and Daughter

MEMPHIS -- A judge ruled that a Chinese immigrant couple were unfit to raise their 5-year-old daughter, leaving her in the custody of the American foster family who has raised her.

Judge Robert L. Childers terminated the parental rights of Shaoqiang and Qin Luo He, who have tried for four years to get back the daughter they put in foster care because of financial hardships.

The judge said it was in the best interest of Anna Mae to stay with the family of Jerry and Louise Baker, whom she has lived with since she was a month old.

Not at all unexpected or surprising to Family Advocates.  These absurd "decisions" are made thousands of times a week in unconstitutional Family Courts based on the "Best Interest of the Child" criteria.  Which criteria was fabricated by the UN Convention on the Rights of the Child.  Unratified by the United States.  Used as the pretext to disfranchise biological parents on the whim of the state (and to the benefit of the state).  Foreign law enforced in the US is highly unconstitutional. Nobody cares but the disfranchised.

In Tennessee, a Chinese couple (biological parents) has been vying six years with a US couple for the parental rights of Anna Mae He.

A grave injustice was done to a Chinese family.  On May 12, 2004, a Memphis trial judge Robert Childers terminated not only our custodial, but also Parental Rights of our six-year-old daughter, Anna Mae, to clear the way for a wealthy local couple to adopt her
despite our five-year fight for her return.  

At 4:30 pm of May 12, Childers completed his verdict and waited no time releasing his 72-page opinion (supposed to be sealed adoption file) to news media electronically before we could even receive it. Actually, our two attorneys, Mr. Siegel and Mr.
Gordon, did not receive the ruling either by email or by mail but had to obtain a copy off a website eventually.  Other than character assassinations of the birth parents, Childers's opinion contains unfounded assumptions, illogical inferences, and distortion of facts. 

Accompanied by termination of custodial AND parental rights, Judge's ruling bars our family (including Anna Mae's two siblings, Andy and Avita) from contacting Anna Mae, direct or indirect.  So the siblings' rights of Andy and Avita are stripped off, as well.

Then on May 14 (only two days after his ruling), Judge Childers took the initiative to issue a well-prepared public statement to news media, trying to justify his decision.  Childers encouraged the public to read his opinion off the Internet.  His public speech, intending to affect the outcome of our appeal, was quickly and widely broadcast.

As parents, we had never been judged neglectful, harmful, abusive, or unfit until the day of his ruling, in which Childers declared us to be unfit parents.   How can we be unfit to one child and fit to the other two?   Do Andy and Avita have the rights to associate with their sister?  We don't have an answer.   At present, we are worried that our other two kids might be taken away from us because we were ruled "unfit".

Immigrant groups protest judge's Supreme Court candidacy

NASHVILLE, Tenn. (AP) -- Immigrant groups from Memphis protested on Thursday a judge's nomination to fill a vacant seat on the state Supreme Court, saying he showed prejudice in ruling that a Chinese couple couldn't keep their child.

But Memphis circuit court judge Robert "Butch" Childers was not among the three finalists picked by the state Judicial Selection Commission to fill the seat vacated by Chief Justice Frank Drowota. The governor makes the final choice.

The panel picked Livingston circuit court judge John Turnbull, Nashville court of appeals judge Bill Koch, and state Supreme Court administrative director and former circuit court judge Connie Clark.

Bob Cooper, the governor's attorney, was not picked by the panel.

Eight judges applied for the court's first vacancy in seven years. The person selected by the governor serves until the August 2006 election, and then would appear on the ballot with the other justices for a "yes" or "no" retention vote for a full term.

Representatives from the Greater Memphis United Chinese Association and the Greater Memphis Immigrant Task Force spoke to the commission denouncing Childers.

They said Childers showed racial prejudice in a case last year over whether a Chinese couple abandoned the 6-year-old daughter at the center of a five-year custody fight. The judge ruled in favor of allowing an American couple to keep the girl.

"We believe he allowed his bias and prejudices to cloud a legal decision," Jinliang Cai told the commission.

In pitching Childers candidacy to the commission, supporters said the judge is competent, fair and intelligent.

"He does not back away from controversy," said Memphis attorney Dorothy Pounders.

The case of the Chinese child is currently under appeal.

Drowota, who is chief justice and the second longest serving member in the court's history, announced June 6 that he will retire in September, ending a tenure that began in 1980.

NASHVILLE, Tenn. Immigrant groups from Memphis today protested a judge's nomination to fill a vacant seat on the state Supreme Court.
They said Circuit Court judge Robert Childers showed prejudice in ruling that a Chinese couple couldn't keep their child.

The state Judicial Selection Commission met in Nashville to pick three finalists for the seat vacated by Chief Justice Frank Drowota. The governor makes the final choice.

Representatives from the Greater Memphis United Chinese Association and the Greater Memphis Immigrant Task Force spoke to the commission denouncing Childers.

On June 25, The U.S. Supreme Court, three times in a row, denied the Bakers' application  to stop a Tennessee Supreme Court mandate ordering that Anna Mae He be reunited with her natural parents. The high court also denied their petition to review the case.  Hopefully, the Tennessee Supreme Court ruling stands final.

Chinese-born Jack and Casey He, who regained custody of their daughter last summer after a seven-year court battle, were granted voluntary departure status Thursday, clearing the way for a less-stigmatized return to their native China.

The voluntary departure, which was approved by a federal immigration judge, is a compromise available to noncitizens facing deportation, a procedure that would have barred them from seeking a return to the United States for at least 10 years. A return will now involve fewer hurdles.

Jack He, who already has purchased airline tickets with the help of church donations, said he and his wife want their three American-born children, including 9-year-old Anna, to meet their four aging grandparents for the first time.

"Anna does not mind going to China for a visit, but she says she is not ready to live there," said He, whose other children are Andy, 7, and Avita, 5. "Personally, I would prefer to be in China, but it depends on her emotional and psychological adjustment. We also have two other children. If an American company or a Chinese company in America hired me, we could come back here legally."

He, who has two master's degrees, has been working as a janitor at a Memphis church, but said he could make a comfortable living for his family as a professor in China.
