The Nicholas family and the theft of there 6 children

To whom this may concern ,

We have no legal rights here in chicago illinois to six children that god allowed us to bring  into this world. While our children were at home with us no harm has never came upon them. June 30th 1993 there was no way to prepare for what happen to our family, because this was a nightmare that we have never dreamed of.

DCFS were at our door without any paper work without police ,along with them were three  hospital employees from Larabidas Children,s Hospital . No one had a search warrant or a court order and they walked right out of our house with all six of our children. On July 7th 1993 DCFS gave our children back to us without any documentation  to explain our rights and what was going on.

On July 27th 1993 without notice or warning our children were taking again from school and our home. Three chicago police officers assisted two DCFS officials to steal our children against our will, as we cried helpless and we screamed "why are you all doing this to our family?" and begging them to please leave us alone. We did not see our children until August 19th 1994 as they all were placed with relatives. August 30th 1994 both myself  and my wife received papers from DCFS in Springfield which stated on the papers indicated for child abuse "SCR 536843-A . for allegations code 22 risk of harm .

11/5/93 we filed with DCFS the office of appeals and fair hearings for the indicated findings to be removed and an appeal for the wrongful removal of all six of our children. 11/22/93 the public defenders office file a motion for us to get unsupervised visitation with our children ,it was rejected and denied without us receivng appeal rights. 12/23/93 case set for trial this did not happen as no one showed up in court. No summons or letter of any explanation was ever given to us. In February 1994 the juvenile court at 1100 s. hamilton was rebuilt that cost taxpayers $90 million dollars to rebuid this court ? Who ordered this done and what happen to our children and the case of our family. Next court date without a summons or a notice was August 30th and 31st 1994, two day trial occurred without mother being present or represented by counsel.

To speed this up on November 2nd 1994 our parental rights to see our children were taking away without legal representation or notice of warning .In October 26th 1995 DCFS signed off with child serve stating fostercare was unsatisfactory and the goal of return home of our children was satisfactory and objectives acheived. In February 20th 1996 our parental rights were terminated by default of publication .

On October 6th 1998 we field notice of appeal and a motion for preparation of transcripts and common law records as well as a motion for appointment of counsel. On January 27th 2004 we found out the appellate court dismissed our case because the juvenile court never gave the appellate court the transcipts or the common law records meaning we are being blamed for not being in compliance with supreme court rule 361. On July 20th 2004 the Illinois full supreme court just denied our case for extension of time to file petition for leave to appeal to their court. The ARDA somehow  protecting any lawyers we file a complaint against . A lawyer from the public guardians office that was involved in our case 11 years ago has been working in the office of ARDC since March of 1995 . Just recently a lawyer from the public guardians office on 11/17/03 filed to put a restraining order on myself Jerry Nicholas to stay away from our daughter Wendy Linton who was in a fire with the adoptive parents in March of 1998. A private attorney named Kurt a. Muller we were forced to hire on march 15th 1996 and pay based on our social security checks, we payed him $5,000.00 and he filed a motion to withdraw off of our case on march 10th 1998 for breakdown in communication.

He advertises in the Chicago yellow pages this type of case he specializes in. Also all of the legal aid clinics in illinois state that they cannot represent us in the termination of our parental rights, Jenner  block a lawfirm that has over $400.00 pro bono lawyers sent us a letter in july of 2004 stating there is no one in their lawfirm that can help us in the representation we are seeking.? What can we do.?

What are our childrens rights if they have been told that there parents are dead. ? and what if our children suffered great harm or abuse mentally ,physically and emotionally. We are lost because we have never been charged with anything. The petitions we have show neglect July 26th 1993 and July 27th 1993 shows six juvenile arrest warrants were issued ex-parte to take our children away not child protection warrants.
