To whom it may concern:
My Name is Jason Wyatt. I am a 27 year old Father and I live in Bristol, VA. My nightmare with the DCS has spanned the past 2 years. It started when my wife and I were going through a custody dispute over our 2 year old Daughter Dena, and my wife used what she had learned prior to be the most affective way of winning custody, THE ABUSE EXCUSE.
When no matter what the situation is at hand or proof of the petitioners motives, DCS will automatically and immediately take your rights away, perform what they say is an investigation with little or no investigative training, and render a decision that usually sways to the side of caution regardless of proof, so they say, but it is becoming increasingly known that it is for federal $$$ to the states.
I propose that there be specific guidelines that DCS be made to follow, and a chain of authorities whom will insure the integrity of there investigations such as a DCS buddy system, not only to help insure the accuracy of statements given by DCS workers of testimonies and occurrences, and if a fraudulent testimony is found and proved to be made by a DCS worker or volunteer, that they be removed of their duties and that any and all prior allegations made by others of that worker giving false testimonies be looked into further and any testimony by that worker not be accepted as being creditable.
I also strongly propose that it be a court of law that decides cases in which there is a recommendation by DCS of any arrangements or removal from the home, or intervention stemming from any allegation so that parents experience due-process and all constitutional and civil rights of the people are upheld.
I greatly propose that with all unfounded complaints be an investigation of prior complaints made by the petitioners, also for what grievances or motives the petitioner has towards or against the alleged perpetrator and penalties greatly be enforced, to help insure the quality of reporting.
The basis for which I’m proposing these changes be made within the DCS stems from the nightmare I have lived during which I have accumulated documentation of 22, of 24, total known allegations of sexual abuse made by my wife or those directly associated with her.
I have had to dispute my innocence over 9 separate allegations made against me to DCS.
On one investigation that was deemed unfounded, DCS brought the case back up turned it into a founded case that was unfounded again after an appeal.
I am now appealing a different allegation that was unfounded then brought back up by DCS then was made unfounded again then brought back up again and made founded, which is clearly triple jeopardy and harassment.
I have no history of sexual abuse nor any prior allegations of any form abuse. I have audio tapes of my wife threatening me with false allegations of abuse. I have documentation from DCS stating the clear history of my wife making false allegations of sexual abuse, and she was still granted physical custody of our child and I have not had an unsupervised visit with my child in almost 2 years, and most recently when given by the court supervised visits the DCS appealed to another Judge the same day and had me served with a no contact order rendering me unable to see my Daughter at all, supervised or not.
This is Jason’s story or opinion for what it’s worth. He recently moved to Florida because he couldn’t take the allegations one right after another. One social wrecker got up in court and said that he had molested his daughter during say, March 2002, when he hadn’t even seen his daughter in 2002 until like August. He is a good guy. He left me his story to use for the movement. He’s not the best writer in the world. I edited it some so you could understand it, but you may need more. Strange thing. He speaks very intelligently and is smart, but just cannot write.
The people of the United States of America need DCS to conform to the Law as laid out in the Constitution and to be held accountable for wrong doings or actions that directly affect the people. There is no system of checks and balances within the DCS and all civil decisions are enforced within its own system making them in essence Judge, Jury and executioner and winning the jackpot every time.
No matter what changes if any will occur, it is inevitable that DCS will indicate some people wrongly as perpetrators, but I think if a fair legal trial is granted and evidence is presented and the burden of proof is held to the standard of reasonable doubt as opposed to this could have happened, many innocent parents would be exonerated AS WELL AS stupid stuff like playing barefoot outside, and the hundreds of circumstances of neglect would be forced to actually have criteria and not just be a huge umbrella of anything the worker can conjure up.
